Divorce and Custody Appeals

We have represented and advised clients on appeal in complex and lengthy divorces, child custody and paternity proceedings, collection of child support, Child Protective Act proceedings, attorney’s fee awards, and Uniform Interstate Family Support Act cases. Mr. Caballero is also one of the co-authors of the appeals section in the latest edition of the Hawaiʻi State Bar Association’s Divorce Manual.

We take appeals and provide appellate advice concerning any aspect of a divorce decree, post-decree enforcement, child custody disputes, Uniform Interstate Family Support Act cases, and Child Protective Act cases.

Some representative matters include:

  • Successful appeal to the Intermediate Court of Appeals reversing a family court decision granting sole physical and legal custody over a minor child to father on the basis that mother was denied adequate due process.

  • Represent mother of two children in an appeal concerning father’s failure to pay child support for decades.

  • Represent mother on appeal challenging unequal division of property and award of pre-decree alimony to father based on the improper imputation of trust income and assets to mother.
